Morgan & Morgan scored a major victory after a Florida doctor agreed to pay a $1.95 million settlement to resolve allegations that his practice violated the False Claims Act by fraudulently billing Medicare for medically unnecessary tests.
The whistleblower team of Morgan & Morgan represented Kathleen Siwicki, a former employee of Dr. Arthur S. Portnow who blew the whistle by alleging Medicare billing fraud. Siwicki claims that Dr. Portnow and his practice Apple Medical Group submitted fraudulent claims to Medicare to perform unneeded procedures, such as echocardiograms and ultrasounds.
Dr. Portnow allegedly received hundreds of thousands of dollars as a result of his alleged Medicare fraud scheme. He and his practice also reportedly falsified patient records in order to cover their tracks and justify the billing for the unnecessary ultrasounds, according to Siwicki.
